3. Get married in Canada, enter the US on a tourist Visa and apply for change of status
4. Get married in canada, apply for a k-3 visa
Answer:
Yes, apply for k-1 visa.
I did number 2, but I risked to get kick out of the country.
Forget about 3 (it wouldn't work) and 4 it will take longer than 1
Good luck to you two. Cheers
Do not merry her in Canada. She may get her K visa only with intention to merry you in US while visiting. So let her get K visa so that she comes to US as your fiancee then you must merry her within 90 days, then file for her residency status and employment authorization right away. She'll get her right to work in US within 3 months after you file
From what I have heard.don't quote me I am not a lawyer... is that
1. Will take you 6-8 months on average.
2. Will look shady when you go for your marriage interview with the INS
3. I am not sure they will grant a tourist visa and then change status.they may make her go home and then you would have to bring her over on a spousal visa which takes 12 months on average right now (they are working on speeding that up)
4. I just answered this one in questions 3 - spousal visa
