I think it's fine. They were there way before the Spanish, Mexicans and before those territories were part of Mexico and United States.
The Yaqui, have been living in peace for hundreds of years they haven't heart anyone.
I don't specifically know about them. I do know we have some Tribes that span the border, and they have special immigration status by treaty. Tribes that just have 'relationships' like my people, far enough back, came from Germany, are too removed for any particular status HERE. I don't have any particular rights in Germany, either.

Why did you pose this question to "Educated Americans"? and not "Educated Americans and Mexicans"?
There is a border between Mexico and America. It may not be in the best interest of that tribe but it's there and not moving anytime soon.
You don't do them justice by using terms like indigenous or ethnic. Indigenous would indicate they orginated there which isn't true and ethnic might help you get food stamps but holds little else.
