K-1 visa gives a foreigner one time entry to the USA for marrying US. citizen. The marriage should be done with in 90 days of entry to USA. In your friend's case, this didn't happen.
Legally, he should go back to his country at once. He is illegal at this time and there are nothing he can suing your friend for.(Unless there are spouse abuse cases).
I would recommend your friend to contact USCIS. that is the same place your friend filed I-129F. He will be a problem of USCIS then.

if they really can't work things out she should inform the uscis about it. i know it mean but the guy messed it up and he is illegal.also she sign for him the affidat of support. so it can be possible that she get in trouble if she don't inform the uscis.
