When his father applies for citizenship the legal way and stops breaking the law. All this talk about the poor people and we need compassion for them. Look, who's responsibility is it to look out for Mexican citizens? The US or Mexico? I don't care really about their poor situation. I'm not a lib and I just don't care. Mexico should fix it so that their people don't have to flee from their cess pool country.

Child of an illegal alien if born in US would be a US citizen so there is no choice there.

None. The child belongs to the parent and the responsibilty for rearing that child is his.

Not sure if you are talking about anchor babies or not. Due to our changing world we need to change how we define an American situation. What a cop out that an illegal immigrant gets to stay if they have a kid here, because any child born on American soil is granted American citizenship. These people are using our country. They have so much national pride for their home countries they should invest their efforts where they invest their pride. If you want to live in America, then be an American.

NONE! The parents are illegal and MUST go home and take the kid with them. The kid can't stay here by themselves.
The parents can't legally stay because of the kid since that would be rewarding them for being here illegally. The parents can't get auto citizenship, even if the kid is a citizen. The kid can come back when they are an adult, can speak English and can SUPPORT themselves.
Personally I don't think they should be a citizen since that is a mis-interpretation of the 14th amendment. This amendment was regarding slaves, not the kids of illegal alien criminals.
I don't consider myself a conservative but to answer your question, I wouldn't under any circumstance.

I think the people that had a problem with Elian Gonzalez being returned had a problem with the WAY it all went down. I love the South Park episode about this topic.
If the father was a sick perv or physically abusive and trying to get the kid home with him and there was proof he was better off with his mother in the US. However, that has to be a very rare situation. Most illegals wouldn't qualify. Children should be with their parents and should have the same citizenship status as their parents until they are 18 or declared independant by a judge (emancipated minor).
I wouldn't and I've contacted my Representatives numerous times requesting they pass a bill doing away with such, that anyone born here is automatically a citizen.
If your parents are illegal so are you. PERIOD!

The Cuban Adjustment Act means the kid's mother would have been 100% legal had she lived. The Cuban Adjustment Act means that the kid had a 100% legal right to premanent residence in the United States.
