Answer:
Write to the Law Society at
IRISH LAW SOCIETY
BLACKHALL PLACE, DUBLIN 7
IRELAND
Give them the info in your possesion & they will deal with it. This complaint is not uncommon.
Contact the clerk's office and ask them.
In UK a will becomes public property once the person concerned has died and I believe the lawyer could be in the wrong to refuse to forward a copy of it to you - unless he acts for another living member of the family who has specifically said he must not - then he'd have an obligation to his client.
Also in UK we have a public register where I believe you can get copies, Ireland must have similar rules, presumably the main place might be Dublin. try a search on the net and see what you come u with.
Was it filed with a court? In the United States these are public records and can be obtained by anyone. I don't know what the law is in Ireland but you might ask.
Hello,
(ANS) The laws relating to wills are different from main land England or UK, why? because the Republic of Ireland is an EU country and technically speaking isn't a part of the UK (I know this sounds very odd but I think you will find this is actually true).
**I don't think the lawyer is behaving correctly, this sounds like a fob off attempt to block your access to seeing the document. As to why they would do that is another matter all together, but there must be a deeper reason.
**NO! I doubt you will find an online source for this will (document).
Therefore your only recourse is to write, phone or go in person to the lawyers office and make a formal request to see the will (document) DON'T be put off because they refused previously, & DON'T be fobbed off again either. They cannot refuse your right to view the will (document) especially if you are a direct relative of the deceased person.
Unless they can offer you a VERY good reason why you cannot view the will (document) i.e. client confidentiality might possibly be a reason but normally a will should be considered to be in the public domain.
**If you have problems with this lawyer blocking access to the will, & if you feel this is unreasonable then there must be a legal ombudsman in Ireland that you can take a complaint too?
There must be a legal authority that over sees the work of the Irish legal profession as there is in the UK.
**NOTE: Will's can be a VERY sensitive item because of the values attached to any items left by the deceased person.

Generally, you are only entitled to see the will if you are a beneficiary. However, if it is a WILL and not a trust, if Ireland is like the US, it will have had to been entered into probate with the court. The question is whether you will be able to get it. Here, if you know when and where the person died, you often can. That is one reason why people use trusts, instead, for privacy.
You might be able to petition the court - or tell the attorney you plan to, before you do, which might change his position if there is any right for you to see it.
You must go to the exectior of the will. Very private thing.
