Marriage question?
I am planning to marry my fiancee who is a US citizen while i am an international student.I am concerned about the i-130 petition because she is gonna be going out of state for college.I am thinking about the rule that we have to live together as husband and wife but i dont want to jeopadize her education because she was accepted in to a good university out in virginia while I live in new york.Is there anyway we could go around this?We both college students and been together for the past two years.Thanks

What's wrong with a long engagement? Let her finish her education. You're young and have a lifetime ahead of you.
i don't know about you but if i was in your shoes i be moving to Virginia.

If you have a good reason to live apart, then that should be acceptable. The interviewing immigration officer will want evidence convincing him/her beyond doubt that you are a legitimate couple. If you can prove that with air fares, emails, letters, family photos and an intent to be together, then you should be fine. Your interview will probably be quite thorough though. The I-130 petition is the least of your worries. Your problem will stem from your interview if you cannot produce sufficient evidence showing that your marriage is a legitimate marriage and not one of convenience you will not be give status. If you can wait until after you both graduate I will suggest you do so, if not one of you will need to relocate. The reason being if you are able to produce enough evidence of your marriage(Mortgage statements, joint bank accounts, pictures of you on vacation or at family events, auto/home Insurances, joint credit cards bills, etc) for the first interview giving you conditional temporary status you will not get it. Remember that there will also be another one 18 months later for permanent status and if your situation has not changed you probably will not pass that second interview either. So my advice to you is to think this over long and hard to determine which is more important to you and your fiancee.
