Under the law in effect from 1 January 1983, a child born in the UK to a parent who is a British citizen or 'settled' in the UK is automatically a British citizen by birth

* only one parent needs to meet this requirement, either the father or the mother.
* "settled" status usually means the parent is resident in the United Kingdom and holds Indefinite Leave to Remain (ILR) or Right of Abode. Irish citizens are automatically deemed to hold ILR.
* where a parent subsequently acquires British citizenship or "settled" status the child can be registered as British provided he or she is still aged under 18
* if the child lives in the UK until age 10 there is a lifetime entitlement to register as a British citizen. The immigration status of the child and its parents is irrelevant.
* Special provisions may apply for the child to acquire British citizenship if a parent is a British Overseas citizen or British subject, or if the child is stateless.

After this the categories become more complex and involved. From the above info, it would seem that the earliest age would be 10, and presumably any point after that if the child met the conditions.

If it's an issue I'd see an immigration solicitor for some advice. Don't bother with the CAB, they'll listen to your story and then tell you to go and see an immigration solicitor!
I'm probably wrong, but I thought anyone born in the UK regardless of the nationality of their parents was British - even if they were accidentally born whilst on holiday here!

the person can probably decide what citizenship they want to be when they turn 18 but they are US/UK citizens till that point, they can choose after...thats what happens when your born in the US to a non citizen
They would immediately qualify as a British citizen if the mother (or father, if the couple are married) are considered as legally settled in th UK at the time of their birth- i.e not under any immigration restrictions.

If this is not the case they'd be entitled to register as a British citizen if they remain in Britain for the first 10 years of their life. Fee will be close to £200 if not more.

There are other circumstances which has a bearing on their citizenship which is on the home office website.
I think if the parents are legally living in the Uk, then the child is a UK citizen from the time of it's birth. I'm not sure of the law where the parents are applying for asylum status.

hey arent, theyre given the citizenship of the country that there parents are from unless the parents have been granted UK citizenship. If a dog was born in a stable does it make it a horse? No, the same rule applies to children albeit its worded differently for legal purposes
Vic's answer above is correct. A child can claim UK citizenship if one of the parents is either a UK citizen or permanently resident in the UK, having Indefinite Leave to Remain. In case of doubt, refer to a Citizens Advice Bureau.

The child will most likely also be able to claim citizenship of the parents' own country. For this, the best thing would be to contact the other country's embassy to register the child's citizenship.

It should be remembered that having a UK citizen child does not give any right to stay in the country to a non-settled parent.
