If I marry him.?
Answer:
Factual Info: Marrying for the purpose of deporation is not guaranteed to work. not for the father or for your friend if he is illegal as well.
from experience, being under a common law relationship or just getting married can still deport the guy.
he will need to apply for status as either under "common law relationship", married couple, refugee, etc. there are options.
Immigration officers are not stupid, they know everything.
if you get married he can still be deported, he will need to apply. if you apply, he will most likely almost certainly need to apply for an extension which gives him some time to stay here while his application is in process (they can reject his extensions to stay depending on his situation- this you need to pay for as well). meanwhile, get a lawyer or immigration consultants that can advise you what to do, step by step, application through application, letters, proof of your relationship, etc. in your friends situation, if he is illegal as well and you want him to stay here legally, get married or being under "common law relationship" does not guarantee their stay and they sometimes check if you live together and visit your house for check ups. even if they apply, they have the power to deport them if no extension is given and apply trhough their country and wait there for the answer. These things i know from experience through friends. so be careful, look into it before he gets caught. it wont be easy if he does.
talk to an immigration lawyer I cant tell you what to do because I don't know all the details.
The best way is he leaves to England marry him there and ask for him but you would really have to ask a immigration lawyer to tell him all the details.
You might also have to wait till your 18. you dont have to be 21 for that all you have to do is have a decent paying job
if u get married then he cant get deported. but his dad can still be. try this .. http://travel.state.gov
No that would only get you both into legal trouble and add more reason to deport him as he and you would be engaging in marriage fraud (a crime).
If he has a pending case in the immigration system he will not be deported. All he has to do is keep the paperwork flowing until he achieves legal status.
8 USC 1325(c) Marriage fraud - Any individual who knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000 or both.
Why does an answer like this get thumbed? It is only factual info.seriously YA is screwed up...
sorry, but I dont make the laws...he is illegal even if you marry him...USCIS will not approve him..if he had entered the country legally to begin with, then maybe you could have adjusted his status because he simply over-stayed. Besides...you are 17...you would not have been able to petition for him anyways until you were 21...sorry.
EDIT- But if both of them entered without Documentation or inspection, nothing can be done for them.
TG- who knows? Go figure...prolly just people who are bored..
I used to work with (not for) Immigration prior to nine eleven, and marrying someone just so they can stay here would be illegal. His parents should apply for a green card before he's 18 - if they are here legally. If you marry because you love each other it would not be wrong nor would it be illegal. However, the laws have changed so much in the past few years that it would be best to consult a lawyer or look at the INS (immigration and naturalization service) site. They have all these crazy laws now that they can deport you just because they don't approve of your visa, even though at the time it may have been perfectly legal. Patience helps.
www.uscis.gov There you would find all the forms and info u need to marry him. and once you marry him and file the paper work it would take about 6 to 8 months for him to become a legal resident. after that he would need to extend his resident and at 4 years he can apply to become a U.S. citizen. or he can join the military and became a citizen in less than a year. Remember as soon as u marry him begin doing the paper work. you can do it yourself or get a lawyer.
The best way is to talk to a lawyer. Good Luck
if you merry him it will help him to stay in America but i don't know about it stopping the
Immigration officials sorry i wish i could help more. good luck =)
