How does the fiance visa work?

What forms do I need to get my fiance here and able to work? Where do I need to file it, does she need to file anything? How long does it take, and can she work and live here while the process is taking place? Thanks for any help! Please no comments on how she is just another illegal alien please!!

Are you an American citizen? You must be a citizen to file for a fiance.

You need to file form I-129F and all the supporting documents with the CIS.

When she gets here you must get married within 90 days. Then you can file form I-765 to get her a work permit.

You'll need to file them with the CIS Service Center that has responsibility over the state of Washington and that is the Nebraska Service Center.

She cannot live and/or work here while the processing is going on.

It will take about 6 months from start to finish.

File now, the fees are going to triple on July 30th. Here's a link to the forms. You can fill them out online, then print them at home so they are ready for the mail. Be sure to pay with a money order.

I am from Philippines and got here through a fiance Visa.

My advice is you visit the USA embassy web site of Canada and check the fiance visa forms. There might be some difference in requirements since Canadian are allowed to visit USA easily.

You start from the web site on what requirements and steps you need to do, then go from there.

When I got here, my husband and I were given 90 days from the time I got here to get married or I will be sent back home if we don't. After your marriage, it doesn't matter how soon, she can apply for a temporary working permit. Process her application for conditional residency ASAP, then after 2 years move on to Green card application. As soon as she gets her green card, she can start applying for the citizenship.

Note: Fiance visa is faster than spousal Visa. Get her here with fiance visa first before you get married. In Philippines fiance visa takes 6 month the least while spousal takes 1-2 years.
