Can a british citizen visiting the US marry a USA resident, and would they qualify to apply for a spouce visa?
Answer:
This is how you spell SPOUSE. 2 points.
Sure you can get married but it wouldn't matter for you new spouse--he would have to go through the whole process. I'm not sure about the V visa--never heard of that one.
We have lots of Brits in the US who are great additions to our society: Best of luck to both of you.
You can marry him but i don't think while he is on a visitors visa in the US legally. And even if they would let you marry him he would not get to stay right away. You can go home and marry him before you file for citizenship. It is easier if you become a US citizen (you can also have duel citizenship). And after that it is easier to get him here permanently, and it take less time when filing paper work and all that. But being a permanent resident it is really hard for to get anyone into the states.
You can get it but it will take a long time. It can take a bit of time even if the spouse is a US citizen. And in most cases the spouse needs to apply while the other spouse is home in their country. That makes it faster.
As another said it would just be easier to apply for citizenship if you have been here long enough. Now some will say that you have to renounce your prior citizenship.. which is often true. Most of the time the US does not recognize a true "dual" citizen.
But the UK does not recognize renunciations made in other countries. My mother gained US citizenship. She then simply mailed in a renewal for her British passport to the embassy in Washington DC.therefore not even having to travel home.
I am British and YES I got married in the US on a visitors visa. I never had a marriage visa when I went over to get married.
