Yes,you need to speak to a lawyer and try first to find out if you have free legal help in your area.If you don't have legal aid around call the Salvation Army,Goodwill etc.Some of them offer free legal advise via local lawyers that volunteer time.If you go to a normal lawyer he might give you hope that is not there just to start your case.
There is such an option as humanitarian case but is a long shot.

If he entered legally and you have proof, he might be able to adjust (get green card) by paying a penalty. Consult a local good immigration lawyer.
Have him leave the country and apply for citizenship like every one else.
He is illegal, send him back to Mexico, tell him not to return until he goes through the legal process. This is what he needs to do. Could not get his residency because #1, it was not her legal child. #2. they are all illegal. # 3 move to Mexico with him.
If you are an American, and you want to marry the guy. then marry the guy. It will help more than hurt. He can potentially get residency if you marry.
HOWEVER: Go see an attorney specializing in immigration before you do much more. This way you can put together a strategy on residency, and then citizenship. Legal residency will still keep open the potential of deportment, especially if there is a scrape with the law.
If the current proposed immigration reform goes through Congress and is enacted into law, then there will be an amnesty window that he may be able take advantage of. A reputable attorney will be able to provide options and a strategy.
As far as I know, you can get married and he can recieve citizenship that way, but I would still consult a lawyer on the matter. I'm not completely sure if what I know is valid.

u should marry him, then consult a lawyer! But there are catholic organizations that will help u fill out the forms and so on. I believe he can apply for the 245 i application because he entered legally, but overstayed-he won't have to leave the country. U both can get legally married also. Good luck!
