Can my wife's son get a K-4 visa when she does not have a K-3 visa? She is in U.S. on a B-2 visa.?

My fiancee came to the U.S. on a B-2 visa. When we marry, I understand she can stay here while we go through the I-130/485 process. She wants her 19 year old son to join us. Can he get a K-4 visa without her getting a K-3 visa? Or will she need to return to her country, get a K-3/K-4 visa and return with him at that time?

This might be something to ask the nearest US embassy. The last time I read over those things, I thought that a person had to be a citizen or permanent resident in order to bring children over 18/family over. I could be mistaken, or it's quite possible that it was visa specific, but this is why I would ask an expert at the US embassy.

You cannot adopt him to confer immigration benefits. He needs to be 16 or under for that. He should be included in the I-130. Whatever you, don't fool around and let him age-out. Once he's age 21 it will take a decade or more to get a visa for him.
