No, it isn't. If you've made an illegal alien work for you, you've employed him, regardless whether or not you paid him afterwards. By not paying, you'll only exacerbate the situation -- you'll be subject to a fine by the federal government AND a lawsuit for back wages (and then you'll probably be forced to pay minimum wage, plus interest and possibly costs and attorneys' fees).
The Immigration and Nationality Act is not a license for exploitation, and no court in its right mind will interpret it that way. Nice try.

No, it's not right. You probably wouldn't get in trouble, other than what they might come back and do to you. But, then again, in this country right now, they have more rights than we do and Bush is seeing to that. They could come back and sue you, call the NAACP, and what ever other organizations back them and fine you for not being bilingual. If you did someones dirty work so you could pay your bills, put diapers on your baby, and food on the table would you want to be done this way? Do you think it's funny to use people? You could probably even tell them ahead that you are not paying them and they probably would not know any better because they won't learn english. Then make them sign a paper accordingly. They would not know the difference. Then when they are throwing a fit, you could have them arrested for disturbing the peace. Then they will get deported.

Absolutely, illegals are not allowed to work in this country period. Wage and hour has no jurisdiction to force payment of wages to illegals by anyone.
