My friend was recently arrested on a minor criminal charge, taken to district court (in Massachusetts), and then picked up by federal marshalls in the same court that same morning and is now being held on an immigration detainer (due to the fact that he overstayed his Visa by many years and is technically illegally in the country). He also has to be brought back to court in a few weeks to resolve the minor criminal charges.My question is: is it possible that the Boston Immigration Court release him on personal recognizance when he is taken there this week by the federal marshalls or will he be automatically held in custody and eventually put on a plane and deported. Is there any way to get him out of custody (essentially have the immigration detainer revoked) while this whole matter is pending? If so, HOW CAN YOU DO IT? WHAT STEPS MUST BE TAKEN. PLEASE ADVISE.

Your buddy is going to be deported since he overstayed his visa. Sorry I know you don't want to hear that, but its the truth.
You can try and contest the deportation order. But 99% chance your friend will be deported. He might be banned from ever entering the US in the next 10 years.
