Married an illegal alien...possibly not legally married..do I need a divorce or anullment?
Answer:
Call the clerk of court in the county you filed the marriage license in; they will know who and what is going on.
divorce
contact ins and tell them what she did and if you know where she lives now, better watch the man she is with now could be pretending to be you with immigration or any where else!! you could possibly get an annulment, that is up to the church!!
Legally they should have never issued you a marriage license if she was in fact not properly documented. Lawfully you are married to her.
First you should have known who you married. You need to suffer and plan plenty of time to make sure you don't make this mistake again..
I'd talk to a lawyer in the county where you were married. Bring all the documentation you have and let them tell you.
Any advice you get here may be good information but may not be relevant in the area in which you live.
Good luck.
I think you were married. The real bummer is that her kids by the other dude are probably legally yours. Unless you are exicited by the prospect of paying support on another guy's kids, I would get a lawyer and get a divorce and this mess cleaned up.
I think the marriage made her a legal U.S. citizen.
She obviously married you for the green card purposes only. Yes, you need to withdraw her INS application before she got approved. Even if she already got approved, she only has 2 years conditional green card, meaning if you report she for fraudulent marriage, her green card will be revoked.
Yes you are legally married. Foreigner could get married here without US documents, all they need is their passport. So if I were you, I would report her first to INS then file a divorce at the same time.
Go to the website below and sign up then go to the part about Family Based Green Cards - Through Marriage or a Relative . A lot of people in that forum will be able to help you wth the detail. Good luck.

The clerks do not check for "citizenship", only to make sure the parties are consenting adults and can be married, so your still married,,,,,,
Depends on where you live, bro.I was in the exact same situation. Here in Tennessee,You are NOT responsible unless she can PROVE the children are yours. Go have a beer and celebrate, then go find out if you can swerve alimony by cause of adultery. Good luck and God Bless.if it means anything, the good book says "if they wish to depart, and are non believers, let them depart. You are not bound in such cases."
Sorry to hear about your troubles. I don't know of any state that restricts marriage based on immigration status. Immigration law is federal law and state law governs marriage.
There is a case pending in PA involving the denial of a marriage license based on immigration status at the county level in Hazleton, PA. But even in Hazleton, they didn't go so far as to suggest someone must have a US passport (i.e. be a US citizen) to marry.
Call the clerk's office, but the passport issue is probably not going to invalidate the marriage.
