TN Visa question for a Canadian coming to the U.S.?
Answer:
To obtain a TN classification, she must have ALL the following with her when she crosses the border:
- a letter from the employer stating that she is, in fact, going to be hired ... including the duration of the work (note that this CANNOT be a permanent position, since the TN means "Temporary NAFTA")
- documentation showing that she has the required work experience in this particular field (working for comparable companies located outside the US ... which often means direct competitors only)
- documentation ... i.e. a diploma ... showing that she has the required academic experience (this must be from a non-US program. The company must ALSO include a letter indicating that they HAVE verified that the foreign degree is the equivalent of a US degree offered by the top universities in that particular field. It must also include a transcript of her marks.)
- documentation proving her existing citizenship
- a passport valid for the ENTIRE term of her employment, as given in the employer's letter
Lastly, the employment must fall into a certain set of categories - most of these would be considered "professional" occupations.
By the way, an associate degree is insufficient. The individual must have a Bachelor's degree (in the correct field) as a minimum ... preferably a Master's or Doctorate.
If the documentation is proved to be false (either by the border guys or by the company), she stands a good chance of being deported (with no more than 10 days' notice) and banned from entering the US for at least 10 years. The company, if actually having hired her, may face severe financial penalties and the human relations (and/or officers) of the company may face indivdual fines and probably jail time. The company will also be banned from doing business (directly or indirectly) with the US government.
