This song was released in 1983 before the disgraceful Reagan amnesty passed in 1986 rewarding several million illegal aliens for their criminal behavior. This is the source of Taco Bell's "Run for the border" campaign as millions of illegal aliens snuck in from Mexico before the law was passed to get their amnesty.
Los Angeles used to have very few illegal aliens until this amnesty fiasco.

The apartment complex that I live in is full of illegals now and I play that song all the time!!! When they are getting on my nerves that song is a perfect release for me. makes me feel better. To answer your question I imagine that Geniesis would be in trouble for that song if it was released today.

Under your line of thinking, we'd need to charge Randy Newman with Defamation for "Short People", The Beatles with being suspected drug dealers for "Lucy", Billy Joel for possibly being a suspected arsonist (after all, the guys on 'Cops' say their innocent) & Nena for being an Enemy Combatant for "99 Red Balloons".
Blaming an artist for "promoting" something, when it's clear that it's just a song, is completely asinine, in my opinion. If you're looking at someone to blame for not stopping illegal immigration, I'd suggest you look at the President. He's trying to make the country secure while ignoring the southern border.
