If proved to be true they should both be deported
no because you don't know that person but are in an intimate relationship with them and they could be lying to you as to the circumstances behind why there are here illegally. If you get busted it can be bad on both of you and what if you are in one of those marriages and meet the love of your life?
How is this any different from sneaking over the border
to begin with?
I'm not saying how I believe the general issue should
be dealt with - I'm asking how is this crime any different
than border hopping?

I now am raising her 1/2 Mexican child because the father is in prison for rape/she is dead and the first husband ran off with a illegal alien woman he worked with

If they are the type of person that would commit marriage fraud, what type of a citizen will they be? It shows lack of character and ethics. It also indicates that they wouldn't hesitate to break other laws if it suits their purpose!
If it is discovered after they are granted citizenship, their citizenship should be revoked.
As someone who is married to a US Citizen and going through the Immigration process, I can tell you it is not an easy process. We are in a bona fide marriage. We have to submit plenty of proof of our relationship.
I don't know how those who just marry for the greencard do it. Many people have been denied- it is up to the US Consulate to determine if it is a fraudulent marriage. You do get Interviewed before you get your Visa.
I think it's interesting that so many people are focusing on the illegal alien as the perpetrator and that the US citizen is some sort of victim. That may be the case part of the time but most of the time both parties know full well that the marriage is not "real". A citizen who willingly commits marriage fraud is just as guilty as the immigrant.
There was another person who answered this question who said she was going through the process legitimately with her husband. All the fraud out there makes the process more difficult for people like her and me and my wife who are trying to play by the rules.

Write your congressman and have him/her change the law in your state. It won't happen, but you can try.
If both parties are in it for the benefit ( GC/ money) they must go to jail. Illegals must be deported as soon as possible.
