Is there a way to obtain a V Visa after December 21, 2000?

I am a legal citizen of the US, and my boyfriend is an illegal immigrant from Mexico. We are about to get married, and I don't know how I am supposed to obtain a Visa for my fiance to stay in the US. Do I apply for a Visa, a V Visa, a green card, etc.? I'm not sure how to go about this problem.

There's nothing you can do to get him a visa or green card as long as he's in the United States. The current law requires him to go back to Mexico and wait while you petition him. Since he's lived and worked in the United States illegally the petition will more than likely be denied. After the denial you'll have to file another petition, a hardship waiver request, and get it approved before the US consulate will issue him a visa. It will take at least two years.

He's not eligible for a V visa. You are a citizen. The old V visa was only available for spouses of permanent residents who were already under petition in 2000 when the law was enacted.

You will be trying to get a K-3 visa for your husband.
