What will i do if i go back from my native country and i have pending application from USCIS as fiancee visa?

we have a receipt from USCIS on february 2007. it will really affect our application for fiancee visa?

Answer:
You really better check before you do that.I have heard if you leave the country during a pending application, YOU won't be allowed reentry and you will be prohibited from returning for 10 years.Check with INS web page and if you can't find the answer, check with an immigration attorney, they don't tell you this at INS.

My husband had to leave on the country during his pending application for residency, because of a medical emergency, and he had to ask special permission, from INS...He was allowed to leave the country, but had to get permission.best of luck!
Fiancee petitions are only for those outside of the United States. You HAVE to process at the consulate abroad for a K-1 fiancee visa after the petition is approved. On what visa did you enter? If an I-129f fiancee petition is pending and you entered on a B-1 visitor visa, then you're fine to leave. BUT...

If you already entered on a K-1 fiancee visa, and are now in phase two where you have filed an I-485 application, then you should not leave until you obtain advance travel permission (filed on form I-131).

Very good idea to have an attorney or a legal services office review your documents to determine EXACTLY where you stand in the process before departing. Good luck
you can get a hardship exemption in the event of a death of a close family member. but they prefer you stay here until you get your paper work cleared.
