Now she wants to come here again with a student visa. She has applied for a private school here and waiting for her student visa.
I was told that she has 50% chance that she'll receive a student visa due to what happend before. Any ideas what you think might happen? What percentage of a chance does she have?
Please do not criticize.. I just want your opinions.

I don't know an awful lot about immigration law. What I do know comes from the fact that my niece's ex-husband, who was born in Mexico but is now an American citizen, had family members who were here without documentation or permission.
I think the fact that she came on a tourist visa and then stayed, was caught, and then deported will really work against her. I am afraid that the INS will simply assume since she stayed without permission before, that she'll just do it again, only be smarter this time, and "disappear" so she can't be deported. It's nearly impossible to get back into the US if you have actually been deported.
I don't want to give a percentage of a chance, because it would be inaccurate, but my guess would be that it's a lot lower than 50%.
I don't know anything about legal things, but be by her side all the time. Hope everything goes okay!

it will hurt if they look at her last trip. Tell her the best times to push for visas is the beginning and end of the year. The alot quotas for different countries and types of Visas at the beginning of the year there are more available and at the end of the year if any are left over they need to use it up before they get thier new quota
