Am I still a J-1 student? Please give serious questions.?
so after educating one year in 11th grade .I came here to G.A and My aunt went to a lawyer and signed the paper
that she will support me in everthing because before the Youth Exchange program was supporting me.
I really want to graduate from here and go to college. so anyway, my question is am I still a J-1 student?. When I was in C.A, the program stated that I can't drive and work while I am in U.S . but what about now? who should I contact to find out about my visa status? I thank you in advance for your honest
Answer:
visit your local border patrol station or ICE office and they will gladly determine you current legal status.
You should contact an immigration lawyer. From what you describe, it sounds like you have violated your J status by remaining in the U.S. Your I-94 likely says D/S which means technically it has no expiration date, but you are still required to comply with its terms. It also sounds as if your aunt is your guardian, but not an adoptive parent, which means she cannot petition for you.
Because you are probably under 18, and also because your I-94 says D/S rather than an exp. date, you are not subject to the 3/10 year bars to reentry if you leave the U.S. Still, your intentions will be scrutinized for future visas at a consulate because you violated the terms of the J
A lawyer can help you evaluate possible avenues, and the consequences of departing right now, or deciding to remain.
