Can a nonresident alien on a visa status open a corporation in New York State as a shareholder/founder?

I am totally legal and work full-time with a foreign company. I have SSN, but I need INS work authorization to do anything. I have looked for information and nothing seems to be against it.

Answer:
You sure can and you do not need work authorization or a different kind of visa to start a business. You can change over to an investor visa if you want to stay longer, but you don't have to if you plan to leave on time. Why don't you get an Employer Identification number from www.irs.gov. That will be the tax number for your business. There is no law stopping you from opening a business in this country regardless of your status. Just make sure you pay the taxes correctly, you might want to get an accountant for that. Good luck and much success to you!
There is actually a special form for that.
You need to change your status to an investor's visa.
