I am under the PERM process(which is more efficient than the older process) to obtain permanent residency through employment and I was already approved the I-140 but my lawyer says she cannot file the I-485 (last step) until more visas become available. I do not believe her since she gave long time ago a web address where I could track the status of my process and I see that I-485s filed on June 26, 2006 had been processed, so I do not understand, please HELP. I think she is lying to me.
Answer:
She is not lying. The service center will not accept your application if the visa is not available. They will send it back. You need to see the visa bulletin, not processing dates. The visa bulletin will tell you which date is current for work applications. You have to find out if you are third category or other. If your applciation required at least 2 years experience, you are third, if less experience, you are other. They change the visa bulletin once a month, around the 15th,.

No, it is not a lie. You are confusing the filing date of the I-485 with the priority date of the Labor Cert. You cannot file I-485 until your priority date is current.
