South African to marry Brit, in SA at the end of the year. What are the procedures?

We're engaged to be married in South Africa, but plan on living in the U.K. We are being be batted from one home office to the next and from embassy to embassy, without a clear answer as to the procedures. Can't believe that our case is such an anomaly. We are currently in the U.K and SA partner's visa runs out just over a month after the wedding. Best to come back and apply for Entry Clearance from UK, or stay behind and apply from SA. Help?

Answer:
Do NOT seek to re-enter with the extant visa. It will not avail. Do NOT seek to extend leave to a visa mandadory category in the UK - you will be refused. When you marry in SA, you will need to approach the British High Commission/Consulate for a SPOUSE entry clearance. This link should give you some info.

If you come back w/o the necessary visa you will risk refusal of entry to the UK.

When you are on the right track you should find it's an easy enough process.

My daughter has a British Passport as have the rest of the family except for me. She lived in Britian for 5 years went home to SA and married there and i don't think it took them long to get things sorted out. Why not contact the British Embassey and ask them how to go about it. I would have thought that the SA citizen would need to apply for a spouse visa to join you in the UK. It's quite possible that they would be refused re-entry without such a visa, even though the existing visa had not expired, because they would be considered to be coming for a different purpose. If you wanted to apply for entry clearance, rather than risk doing that on arrival at Heathrow, you ought to do that at the British High Commission in SA. I think it will amount to the same thing as applying for a spouse visa. This will only be granted if yu can show that you can support and accommodate your partner without public funds.

I would suggest that you get professional advice before leaving the UK. Spouse visas are far from automatic. It's worth the money to talk to a solicitor.
