What can happen? fricking immigrant women...?

I am wanting to know alot of questions about this particular situation that I am in. I have a child on the way by an immigrant woman, who has her 2 year temporary residency. In 6 months her husband will have divorced her. She has no green card, just a baby by me. Are there any lawyers, immigrant mothers, social workers or someone that is skilled in law available to help me with these questions???

1. After her 2 year temp. residency expires, will she be deported?

2. How can she collect child support?

3. Can I help to deport here?

4. Can she remain here forever with out a permanent visa?

5. What are her posibilities as a partially U.C. citizen for becoming a permanent U.S. citizen?

6. Does the fact that she has a child with me, means she can reside in the United States for ever, or will eventually she have to re-marry and apply for a green card?

All responses are greatly appreciated, but i would rather have serious and educated responses to this matter.

Answer:
First thing first is if you care about this woman, you should hire or get a consultation with an immigrant lawyer.

The I-751 is normally filed by a married couple, but if you have divorced, or your US Citizen spouse has died, you may file the petition on your own. The I-751 form itself contains provisions for a waiver of the requirement to file jointly with the US Citizen spouse. You may file the I-751 immediately upon divorce or the death of your spouse, and you will be required to provide evidence that you married in good faith, rather than to just get a green card by marrying a US Citizen. You will be required to submit a copy of the divorce decree or death certificate.
The I-751 also makes provisions for a waiver for filing jointly with your spouse, if you are still married, but "battered or subject to extreme mental cruelty". If you are in this unfortunate situation, you need the help of an experienced immigration attorney.

If she got her 2 years temporary residency by marriage to her husband and their getting divorced she can still apply for a permanent resident status.

and even if she and her husbands divorce she won't be deported, and the husband remain responsible for her FINANCIALLY. until she become a US citizen and she have a job.Because when her husband marry her he was her sponsor.

no she can't remain her without permanent visa, but she can still adjust her status. she needs an immigration lawyer or anybody who has more sense that the two of you, so she can fill up the application paper goo.

and yes she can collect child support.

her possibilities to become a permanent resident depends on how she will submit her application on time and fill-up the application correctly.
Are you kidding me, she is free to suck of the public trough as long as her jackpot anchor babie dribbles ameican pee.
By the wording of your question, I am not sure if you're irritated at the woman or your situation...

Hopefully if you care about her enough to have a child with her, you're trying to help her. I'll assume that's true.

My best advice is to talk with a lawyer. You will both need some legal representation. The sooner, the better.

Good luck and try to keep the baby's best interests at heart.
Are you trying to get out of paying child support? You can contact your local catholic charities immigration office to get help on keeping yo baby's mama here if you really want a life with her and your new baby.
sounds like you got someone pregnant and don't want the responsibility of paying child support. shame on you.
if you can prove her unfit you can get the child from her. good luck. wear condoms next time.
i have a baby with an illegal immigrant also.......
1... possibly
2....if she is receiving any help from the state the state is required to get their money back through the other parent or you
3. yes if u want
4. no legally yes illegally
5.... need more info like how long she has been here
6... no they can deport her and since it sounds like she is the primary caretaker she can legally take the baby with her...she can remarry and re apply for a green card

sorry this situation sux i know going through some **** with my baby's father similar to this
You let your little head do the thinking for your big head, & now you want us to bail your sorry butt out..the child should not suffer for your irresponsible ways. but you should. just go on welfare like the rest & get out of my sight...GIT.. p.s. better stop smoking newports. your going to need every cent you can get, & I'M NOT PAYING FOR THEM!!
Why did you have a child with this woman who is married to another man, whom you want to help deport? If she does become a legal resident she will have rights and will be able to go after you for child support. If the child is yours shouldn't you want to take care of it? She can't just shack up with you and not get deported. They don't give permanent visas.
Take her and baby back to Mexico and you stay there with them .
For your sake, I hope she is deported.. For the tax paying people of this country, I hope she is deported too.
