Illegal in the U.S. Part two. What is the process ?

As of right now, they are booked, if being here illegally is all they have done, they are give a court date, and set free, keep in mine that most do not show up on that date. The others are held, in most cases they are wanted, or have a fake or stolen ID, and or SS card, those go to court, and do jail time, or deported ( but most are back in just days ). This is how it should work, right to jail, right to court, and right to a waiting bus, next stop, home sweet home.

at this time most undocumented immigrants are deported administratively. this means that there is no criminal charge. very few are released as in the past. applying criminal charges to those illegally entering poses the problem of how much room is available in the prisons now in use. not enough. fines will not work. many do not have the money pay those unless they are minor. even then they don't carry money with them. i do believe however, that any one in the u.s. illegally that commits a crime should be prosecuted at least at the level of an "a" misdemeanor which has jail time and a fine.
as for the process of assigning punishments and penalties. gather information concerning dwi's, arrests, false use of social services, and any other crime commited by illegals and place with a signature sheet containing proposed ideas. say conviction of dwi -- 6 months in jail and deportation to home country, etc. and if work is in the mix make it 6 months at hard labor.
