My fiancee faces deportation even though he has been here all his life ..what can I do?

My fiancee was born in Brazil but has been here since he was 4 years old. He was previously married to an american and could have filed citizenship staus many times and he regrets never doing so. He recently got into some trouble and went to jail unfortunetly his resident alien staus prohibits that now INS wants to deport him. He speaks no portugese and has no family in Brazil, they are all here. In addition he has 2 young daughters here. I am also engaged to marry him and I am an American Citizen. Can INS actually deport him just dump him off in Brazil with no family and no understanding of the language there? I mean he is as American as me and he knows he made a mistake ,but sending him to jail is one thing ,sending him to Brazil is a death sentence , seeing that he would not be able to come back to America ...What do I do??

GET ANOTHER GOOD LAWYER if he doesn't have a criminal background and this was his first offense then it could be droped to a mis. ,but some judges are very racist if he was here all his life and he paid taxes and has proof he was here working then he wouldn't have a problem trying to fix his residency but with a mis. he can pay a couple of grands and it can be erased from his record. Ask the lawyer if you can take this proof I have a good friend that was caught in a casino for having a fake id and he was taken to jail and was going to be charged with a conviction but his lawyer nego. with the judge and the state attorney and his charge got droped to a mis. and then they wanted to deport him but his lawyer told him to gather all the information he had since the time he was here like bills he paid his mortgage taxes and his children ages. and ect. well till this day they are still in court but now they don't want to deport him they want him to go to jail and his lawyer is fighting against this bc the states attorney first said this was a petty case then by the next court date another took her place and that's the women that wants him to spend ten years in jail he has good refrences from previous employers he owns his own buss. now and he does everything by the book. but he's waiting to see what happens hang on there talk to the lawyer and tell him or her that if he can't do what he says his gonna do then you guys are gonna walk I think my friend pays the lawyer 1,075 dollars for each court appereance this is his fifth one and plus he had to pay other court fees but all I can say is your not alone and there are always good people with good hearts willing to help and don't listen to the small minded people on here giving you crap their just taking their life's frustation on someone else I just say pull the trigger god bless you hun

He should have come to the US illegally. Than the government wouldn't even charge him.

If he is some kind of violent felon, then they can deport him if he is not a citizen.

They certainely can. If you want to assist him, you can:
1. Wire him money to leave Brazil
2. Marry him (securing immediate citizenship)
3. Go talk to the INS

Frankly, he should be deported. This country doesn't support "squatter's rights". If you're not a citizen on paper, you're not a citizen.
get a lawyer. it's hard to believe his parents didn't talk to him in their native tongue.
He is not as American as you because he is not a citizen..Say bon voyage..when he gets there he needs to figure out how to get over here properly and maybe you can help him.I don't feel sorry for him or his illegal family.

You say he was once married to an American,apparently he didn't do it just to gain citizenship since he didn't bother. I love by the way how you talk as if being dropped off in Brazil is like being dropped into Beirut. I'm pretty sure they aren't planning on dropping him off in the jungle,so the melodrama is a little over the top. As a child one could argue to have a little mercy,but he is a grown man,and did he not know that if he got into legal trouble he could be deported? And of course if he got into legal trouble I have to wonder why,because that would have an impact on whether I care. But if he was a legal alien,he and all of those with that status know that commiting a crime can get them deported,kind of like being on probation. Then you get in trouble and suddenly we aren't supposed to do it in this case,because he is what somehow different? Anyway Brazil is beautiful this time of year anyway.
