If you are here illegally, even if you over stay your visa, you are all illegal aliens, and the fine is deportation.
Because of national security and tax burdens threatening the economy and the current citizens, there should be no grey area in this matter. The law should be strictly interpreted and acted upon. To do otherwise hurts our country and sends the wrong message to tax payers and other nations.
If my drivers license expires and I am still driving, I am driving illegally. Visa expires, still here? It's illegal. Gotta go back. Do I know the process? My father came here way back when, did it legally. Which is why they had sponsors, someone to make sure the immigrant was cared for until they could work. Took about a year to process the whole thing. But back then they felt it was worth waiting for.

Yes, it might be expensive, but it can be done. My father did it. So have lots of others before and after him. He sailed over, long trip, and he started working and saving immediately. That was what the sponsor was for. So he could get on his feet. Where is your sponsor? Can't they help?
It is not the American peoples fault that he can't afford the expensive paperwork. He should go back to his home country, save up some money there, then do the paperwork correctly, THEN return.
You should of also looked into the law before you married him to find out exactly what needed to be done. BEFORE he overstayed his visa.

You mentioned part of the problem in your third question. Most of the American people, voters and non-voters, and people who will post to your question Do not really understand the desperate situations these people find themselves when they decide to come here illegaly. They don't know that it can take up to 10 years (even now without the new bill.) to even begin to apply for the "legal" method and when they do they have to pay a 3,000 to 5,000 dollar fee on a 5,000/Year Salary. Bottom line is they don't care. Forget what the negative and ignorant people have to say. Be hopeful that the country's law makers understand this and make a reasonable and humane change to our now ridiculous and incompetent immigration laws.
Once you overstay your visa, you're illegal. Some of the laws aren't fair, but they aren't going to get changed overnight. You took the chance to get married knowing what the laws are and what would have to be done for this to become a permanent legal situation.
My child's father cannot even come over from India to visit his son because of all of the people who are given visas and overstay and never return, according to the embassy director. So, instead of the father leaving his family farm where timing and losing a job is not an issue, I have to save up every vacation day I can to spend two weeks over there, not to mention having to buy TWO tickets, which certainly isn't cheap. So, I really don't have that much sympathy for you. You knew what you were getting into. Either make it legal or face the consequences.
Someone is really mixed up here. I have a friend who married an illegal and he is allowed to stay here. Why are you having to pay all this money if he was here legally to begin with? I don't know, this is really confusing. You need to check into this a little harder, I can;t believe they would make your husband leave when you and your baby are U.S. citizens.
