What is the process of marrying a former illegal immigrant?

My boyfriend over stayed his visa in the States and now he's gone back home. However we want to be together and want to get married. If I marry him will he be able to come back to the states?

Answer:
Yes, he can come back. However there is a penalty depending on how long he overstayed. If it was six months or less he's banned for 5 years. If he overstayed for a year or more he's banned for 10 years.
He needs to file the paperwork before coming back to the US and then you can get married.
