Serious question seriously!?

Should it be fair if a woman from lets say Asia gets pregnant there boards a plane for America and gives birth here, should her baby be a US citizen? Even if that's has her plan all along so she wouldn't have to go back home

It was never intended to be utilized in the manner that it currently is. The authors could never have envisioned hundreds of thousands of people sneaking into this country just to breed. This number varies due to illegals not having to declare their citizenship when getting their taxpayer funded hospital deliveries, so nobody really knows the true number.

In 1994 CA voters tried to stop it but a activist judge under pressure from mexico, declared it unconstitutional. We need to demand that our lawmakers represent US not mexicans.

Just because a baby is born here does NOT make it a citizen. Only after the mother and/or father has done what it takes to become a citizen does a baby or child become a citizen.
the law does not say they are citzens. the law states that at least one parent must be american.

Even if the child is a US citizen, the parent would have a hard time immigrating here ahead of others from her country, since the child is not over 18 years old; and since the mom had not resided in the US.
No, that turns child birth into a lottery system and tells women to risk all (including the health of the child) to make it to the US so that the child will be a citizen and the mom and/or father can obtain the benefits of a lucky birth (hence the name jackpot babies), not because that is what the law actually states or intended but because of the charity of kind American citizens who think that a child born within the confines of the US is a citizen. The idea behind the original law had good intentions but is now being grossly abused.

The law says that if the baby is born here, then the baby is a U.S. citizen (unless born to diplomats or foreign heads of state/military who aren't subject to our laws). But, the mother is not a U.S. citizen. So, she could be deported, then the child could file for a green card for the mother once he/she turns 18.

If we pass a law that says both parents have to be citizens for the baby to be a citizen, then what about babies that only have 1 parent who is a citizen? My daughter has only 1 citizen parent...that would put her in legal limbo. I think the idea is too strict as we are a nation of immigrants, we should not have to show a pedigree to be citizens. I prefer the law the way it is, that if you are born here you are a citizen. Just enforce the borders better, keep better tabs on people who come in on student/tourist visas then overstay their visas and have a kid. That would solve the problem right there.

It doesn't matter where she is from, that simply shouldn't be the law. Every EU country and Canada have already abolished automatic birthright citizenship. It is simply to vastly abused in a country that gives benefits to its poor and allows family preferences to immigration.

To the post above, I think if one parent is a US citizen AND LIVES WITH THE CHILD that should do it. There are lots of ways to draft it.
I have a friends they do the same think you doneor she want to try, but the kids are now US citizen but that was 10 years ago,now I heard they can't be US citizen if the both parent are NOT citizen.

No it's not right at all. I received an email the other day that I think fits this pretty well and would like to repeat it here. Theodore Roosevelt said this in 1907 and it is so true I think every American citizen should read it AND every person thinking about immigrating to America.

So, I believe that anyone coming here from another country should be prepared to live according to our rules and not expect us to adapt to theirs. The baby was conceived in another country therefore it is a citizen of that country not ours. Our ancestors who came here from a variety of countries had to learn the language why do these new immigrants expect us to learn theirs? They are not asking "what is good for america?" They are asking what is good for me? Also is she doing that because she can receive govt. aid? This is ridiculous and we need to stop the madness. I say, Press 1 for english. Press 2 for deportation.
