Ok..so I'm in love with a guy who is from Honduras...Is Amnesty still around?
Answer:
Let Them Send That illegal back. this is getting out of hand. If you are breaking the law you are a criminal. simple and plain
Not a whole lot of sympathy here, he needs to go back and apply properly. If you care for him enough go back with him and get married, then move back..
If you marry him he will get visa C. And after few years passport. So if you're ready do it.
Are you guys married? and if so, did he come to the US legally (visa)? If he came with a visa and you are both in love best thing to do is get married and then file a petition I-130 he can wait for his green card in the US.
If he came here illegally then there is nothing you can do for him. Unless you still want to get married and file I-130 but he would have to go back to Honduras for his green card and he would be prohibited to come back for 5-10 years for being in the US illegally.
You might also want to find out when he got here... if he got here here before January 1999 he might qualify for TPS. best thing you can do is consult an attorney. Hope this helped a bit... good luck
First of all, ignore all the hateful "answers" you might get. Here's a serious one, and I hope it is helpful.
If he entered the country legally, on a tourist visa or otherwise, once you get married, you can file for a green card as an immediate relative. You just have to provide evidence that you support/can continue to support him financially and also provide proof that you ahve a legit relationship.
If he enterred illegally, he needs to go back to Honduras. From there, you can apply for a fiance visa, and he can re-enter 3 months before the wedding (he can also work legally during this time) and then once you are married you apply for the green card.
Either way, I HIGHLY suggest hiring an immigration attorney (there are also non-profit services in major metro areas whih are cheaper). Best of luck to you both.
He shouldn't be here in the first place. Quit trying to help him cut corners. Just go back to where he's from and live there.
Sorry Hun. I empathize with you, my wife is a legal Honduran immigrant, and we just got back from a trip to Honduras. What he needs to to is fly home go to Tegucigalpa, and apply for a visa. They are not too hard to get there. But he screwed himself by creeping in like a common criminal. I love LEGAL immigration but deplore what you man has done. It is a crime and now he will dodge the migra for the rest of the time he is here and you will have to live with the possibility of losing him. Oh and Marrying him may do more harm than good and his status will make it difficult to get a marriage license in most states so he will need to STEAL someones social security card, furthering his criminal career. that is what you are up against.
I have a feeling after the Fort Dix thing Amnesty will soon be a dead issue.
When you post a question, you give up the right to control the answers.
I have been to Honduras. i loved it there it is very beautiful. The country the people its simple living. The prices for stuff though that was a little out rag-us. when i was there in 2004 22 of there dollars to make an American dollar. If yo love him marry him. if you ain't sure then let him go. Best of luck. Port Castillo rocks.
I'm sorry that you have to deal with ignorant people on here. I am married to a mexican and the first time i tried to ask advice about anything all I got was a bunch of hateful responses. The truth is people are just hateful. No one is even trying to approach the illegal immigration issue like reasonable adults. Everyone wants to hate and be racist and say stupid things...As far as to answer your question, it depends on how he came here. If he came in without inspection(ie he crossed the border without them knowing), then he is pretty much out of luck for now. It used to be when you married a US citizen that you could automatically become a legal citizen too regardless of whether you came over with a visa or illegally crossed the border. I talked to an immigration lawyer who told me that they are closer than they have ever been to an immigration reform and to just hold tight. This is what I've been doing...If you were lucky enough that you man came over on a visa and maybe just overstayed his visa expiration date, you might be able to get him legalized(my friend's husband is from argentina and that is what he did)...you'd just have to get all the necessary paperwork to do it. Either way, don't lose hope. Something will happen soon. They are never going to be able to deport 12 million people so they are going to have to do something...Good luck!
Just another FYI, Be weary about just sending him back to Honduras...It's not that easy. If the US gov can in anyway prove that he was here illegally they will ban him from coming back to the US anywhere from 3-10 years and possibly indefinitely if he has been here for many years. This I was told from an immigration lawyer.
and to the person that told you you can't get a marriage license without a ss# that is false. They ask for it but if you don't have one they don't care. People can get married in what ever country they want. He just needs to have a honduran birth certificate and an ID.
If you marry him you can petition for him with an I-130..or even if you just plan to marry him you can petition for a K-1 visa which is a fiance visa.
Either way he needs a relative here...If nothing else google immigration papers and find some answers.
Good Luck!
If you really love him marry him. This is the only way you'll ever be able to keep him with you. Best of luck to you both and do not give up on happiness!
P.S. Don't mind the haters; They are God's creatures just like flies and roaches!
