I'm an American born citizen, and I want to marry a Peruvian woman. How long does the I-130 form take?

We've been travelling back, and forth for a year 1/2 now seeing eachother. We're VERY much in love. She has her B1/B2 visa. She can stay in the US for 6 months at a time before having to return. She's coming back here in April, and we plan to marry in June. Right after we marry I want to file an I-130 petition for her. How long will it take to process? What do I do if her 6 months are up on her b1/b2 visa before the I-130 approval? OR can I file for her I-130 now, before she comes here? I just don't want her B1/B2 visitor visa to be up before the I-130 approval. I will be filing in NYC. I don't really know if that makes a difference, thanks.

Answer:
It would be best for her NOT to enter the US with her B1/B2.
Instead, there is another visa called K1. This is for the fiance of a US citizen.
At the port of entry, the alien fiancée will receive a stamp in her passport giving temporary permission to work pending marriage to the U.S. citizen. The marriage must take place within 90 days of admission into the United States. Following the marriage, the alien spouse must apply to USCIS to establish a record of entry for conditional permanent residence status. After two years, the alien may apply to USCIS for removal of the conditional status. You can read about it here: http://caracas.usembassy.gov/wwwh2478.ht...

I do not recommend that she enter with her B1/B2 because it is not an immigration visa. When she was granted that visa it was with the intention of returning to Peru. If she uses it to enter and stay, it could be seen as fraud and she could be denied PERMENANTLY. The risk is too great seeing as there are other options. You can verify this by calling the National Customer Service Center at 1-800-375-5283.

You can also get any information you need at www.uscis.gov.
The US Embassy in Lima also offers their assistance.

Look at this site for processing times:

Your Service Center is Vermont.
not long enough!!
8 months to 10 months
before that
you have to get married in peru and do a lot of paper work there that will take you very long days
then when you come here with the paperwork
you file the K1 visa for her as your wife
