How does a person who is here illegally go about becoming legal here?

If an American citizen married someone who came here illegally from another country, how can the citizen go about helping their spouse become legal? And please...no rude answers or anything like that...

What I think is that the illegal person first has to go back to his/her own country. The US citizen has to apply for a K3 visa if they are already married, if just engaged this person can apply for a k1 visa. You need to be able to sent in a lot of evidence of an ongoing relationship. The fact that the person was illegal here, may not work in it's benefit, so make sure you give them all the info and a bit more if you can whenever they request. The person applying to live here will be asked if he/she stayed illegally in the US, so you might want to hire an immigration lawyer to help you cover that in the right way.

I believe there is a requirement for the marriage visa that you had to have come legally. Check with uscis.gov.

The US government is in the process of working on Immigration law changes. If that happens, your spouse could apply for you, but it all depends on the changes to the laws. Keep a watch on the news, then hire an attorney to help. Now, don't give anyone any money to help, because there is nothing that can be done. Marrying a US citizen only makes you married, nothing else, unless you are legal, then you can apply to Adjust Status.
The illegal spouse will have to return to his/her country of origin while the American spouse files Form I-130 "Petition for Alien Relative" available at www.uscis.gov. The American spouse may accompany the illegal spouse to his/her country of origin while waiting for the application to be processed if he/she chooses to do so.

Marrying an American citizen does NOT guarantee citizenship, and coming into the US illegally does hurt the application. Good luck.
Go back to their native land, put in the appropriate paperwork, the fees per application, and wait. That's the legal way in America, and other countries.

It might help if the woman in the marriage was pregnant by her spouse (regardless which is here illegally), it would show that you really are committed to each other. Show assets in both husband/wife names (as husband and wife)... i.e. house, car, bank accounts etc etc.
