The H-2B work visa-Who is officailly considered as an employer?
My family is looking into how we can hire a certified live in home health care worker from the Philippines and if it is possible to do that by her using the H-2B work visa.
Through our church we know of a certified home health care worker who is willing to come here to do the job.
I have been to the official US Embassy web site and others and the immagration web sites, but no info on if a family can be officially considered as an employer.
So I need to know the answer to that and if we can be considered as an employer how do state and federal income taxes come into the situation?
Do we have to register with the state and or city as an employer and or business?
Also if we can bring this women here using a H-2B work visa if it is approved about how long does it take usually to get it approved?
And how long can she stay here on that type of visa.
My elderly father has an undetermined amout of time to live.

I am certain that you wouldn't have to get a business license to hire someone to work in you home. You probably are going to incur some special 'liability' as a sponsor for the helper that you are helping to obtain a green card for. You will have to issue them a 1099 tax form for wages paid over $600 per calendar year. Room and board that you provide for them should be part of their 'salary' as well. The worker should not be responsible for federal income taxes or SS tax, I believe, if they are only a seasonal or temp worker. But, they may be liable for some state or local taxes, depending on you location. You would do well to consult with your tax professional or a CPA.
H2B visa is for temporary/seasonal, non-agricultural employment in the USA by foreign nationals
