If you are a citizen and you married an illegal alien you will have to have to have your spouse re-enter the US legally in order for them to obtain a Visa.
If she is illegal, she MUST return to her home country to start the paperwork. Your son, if he was born here, is a citizen and can stay but she CAN'T. She's an illegal alien. A child or a spouse doesn't give her automatic citizenship.

If she married you and it's legal and binding marriage contract, performed in the US, she is now considered an American Citizen. Surely you had to know that. I bet she new it when she married you!

Of course, the INS will be checking on you two, form time to time, to make sure it's a real marriage and on a fake one to help her get citizenship. I think you have to stay married for at least one year or more for her to become a true citizen of the US.

I married a foreign gal in the US nine years ago and she did not automatically become a US Citizen. The fact that I was in the Military for 25 years, a fighter pilot with 147 missions in and a POW for a year did not mean a single thing to the INS.
We went through the INS process and it took a year before she obtained her paperwork to live in the US. The cost was near $1000 US.
We lived out of the country and the INS took her foreign passport and have her a letter stating she was in process of becoming legal citizen.
That's the facts. There is no way around it.
