As long as you are in valid nonimmigrant status and you are from a country with which the U.S. has a treaty of commerce, you can apply for a change of status to E-2.

Go to that page. It is a clearinghouse of government information. Type in E2 Visa in the searchfield. I just did it, and there were lots of responses - many of which listed the names of particular countries.
