OPT to H1B convert?
Answer:
If you work without a valid EAD, then you violate your status and are deportable even if you later get your H1B.
Well if they are wiling to sponsor, they aware of complications and will deal with them, once theydecide to hire you. You might just start later (Sfter H1B is approved), Or they hire you with EAD, submit paperwork, And then "neglect" your being working there between EAD and H1B. (unless you bring that up). So find a sponsor.
Generally the USCIS offers a bridging period in situations like this. Here is what I would do if I were you
1) Talk with the International office in school
2) Participate in free chat with lawyer like Sheela Murthy
http://murthy.com/chat.html
3) Post on forums on www.immigrationvoice.org
You are unfortunately caught in a gap, as many international students are, between F-1 and H-1B. In times past, USCIS allowed students to remain in the U.S. "in limbo" until they could begin their H-1B status on October 1. However, they have not extended that relief to students for about four years now.
You cannot extend your OPT, nor work without authorization. Your only viable options to remain in the U.S. in this gap period are to return to school for the summer/early fall, or find an alternate immigrant or nonimmigrant visa.
Good luck!
