My boyfriend lives in Canada, we've been together for 2 years now and have to hop border to border just to see each other (yea it's hard, but, he's worth it). He wants to move out here to be with me, the embassy tells me the only way he can move here is to find a job sponsor and they have to PROVE an american can't do that job. NOW, I live in a town of approx. 893 people, jobs are scarce enough as it is finding a sponsor is nearly impossible!! (A job, yes.. sponsor, no). Then we decided probably marriage, we are in love so regardless it wouldn't be against anything we believe in, but that alone is gonna cost like 2500 dollars (that's bullshit, I don't have that in my back pocket). There's gotta be a loop hole in the system, I tried to do this as legal as possible and got fucked over in the process... now, I want to do it legally, but perhaps find a loop hole, it shouldn't be that hectic for someone from another country to move here. Can anyone help???
Answer:
While applying for a K-1 Fiance Visa or a K-3 Spouse Visa may end up totalling $2500 or more in the end, its not an amount that needs to be paid all in one lump sum up front. The fees that are required are to be paid only at certain stages of the process.
The K-1 is cheaper to file than the K-3 and faster. A K-1 Fiance Visa would initially only cost you $170.00 to file, plus $100.00 at time of interview and cost of a medical (varies by province). Where it starts to become more expensive is when the fiance is already in the US and you file for the Adjustment of Status & Employment Authorization.
As for a loophole, the only one I know of is to enter the US as a visitor and just stay. This is illegal, since you would clearly have intent to enter the US with the sole intention of remaining. It's possible to get away with it, many people have. You're concern would be to be able to prove to USCIS that there was absolutely no intention of entering the US to marry a US citizen and remain in order to circumvent immigration law. If your application for permanent resident is denied, there would be no option to appeal the decision as there would be with a valid visa.
