What is asylum?

Answer:
Mostly people apply on arrival in another country, claiming that they would be in serious danger if returned to their home country. Occasionally people claim at a foreign embassy in their own country, or else when they have already been in the other country for some time, on a visa for example.

Asylum claims are treated under the European Convention on Human Rights. For a a claim to be accepted, you have to establish that you are at risk of serious harm because of your politics, ethnicity, religion, etc. - ie not because you are a criminal, or just because life in your country is hard or dangerous. The onus is on the claimant to show why they should be protected.

Within Europe, claimants must claim in the first European country they come to. If it can be shown that they have come through another country that has signed the Convention, they will be returned there to have their claim considered.

Asylum is a form of protection that allows individuals who are in the United States to remain here, provided that they meet the definition of a refugee and are not barred from either applying for or being granted asylum, and eventually to adjust their status to lawful permanent resident.
In my day it used to be a place for people that are mental.

Asylum-seekers can apply on 5 Convention grounds (as stated above). If accepted they will become refugees and will be given 5 yrs leave in the UK subject to active review (before Aug 2005, they used to get ILR). If refused they can still be given some sort of leave either Discretionary leave or Humanitarian protection.
