Parents greencard process when they are in USA on visitor's visa?
Answer:
if there visitors visa has not expired they can stay but if it has they need to go back. Since you are a US citizen, they will probably get an approval within 6 months from the DOJ but with the back log on passports etc it might be a bit longer. Being out of status is not fun especially if their visas expire before you get the approval
It is also dependent on where you made the request for them to be. Look carefully on the receipt. if is has the designation of Ind then the number, they need to be in India to complete the process.
I need this same info
I think they can stay waiting once the INS acknowledged receiving the information. I have friends whose parents simply waited here while the darn paperwork were being processed. But it took a damed LONG time...
I have the same issue. Parents are in US on tourist visa and they got 10 year multiple entry visa. 6 month period ends next month. I am a US citizen and already applied for I-130 for them and received the acknowledgement (not the visa number) from USCIS.
I wanna make sure that they can stay here until they get the greencard. Also it won't have any adverse affect on the processing of the greencard. Does anyone know any specific website that talks about these guidelines or any documents?
