About I864?

my husband got the I130 approved now I am filling out the I864 but he just called me today saying that he recieved a letter from homeland security stating that nobody is filling out his papers I have not sent in the I864 because I just mailed out the payment. Is it normal for Homeland Sec. to do this or what should I do?

First and foremost, never assume that USCIS never makes mistakes! They made a couple of big mistakes that ended up putting off my husband's permanent residence for about a year, and putting us through a ton of frustration in the process. (At one point, we were told they lost an application and that we had to start all over again!)

If I were you, I'd get everything together the way you should, according to USCIS's process. Then, when you're ready to send it in, set aside a few hours (their wait time is horrendous) and call them to talk about the situation. I would also call a few times, to talk to different people. You wouldn't believe the number of different responses I've gotten from them for the exact same questions. Then, once you get some kind of consensus, continue doing what you're instructed to do. Also, it's probably a good idea to document the details of each call, so that if a problem does arise, you'll have something to refer back to.

You're in the middle of a frustrating process, and I can't describe the relief you'll feel when it's finally finished. Good luck!
Honestly, I don't think anyone here is going to know what the heck you are talking about. I certainly don't. I suggest you ask a qualified individual at the Office of Homeland Security.
