ok...the baby thing is REALLY sticky. i'm not sure why she is saying they will take away her temporary visa...it's a "tourist visa" and it's valid for 10 years and they can't just "take it away," for no valid reason at the border...no way. they can turn you away, but they aren't going to take the visa. if she's crossing by foot or car at the international bridge, she should have received a temporary PERMIT to travel outside of the border zone after she presented her valid tourist visa. THAT permit has to be RETURNED when she leaves!! she wasn't suppossed to keep it! that alone will make them mad. everytime you cross the border you have to present your valid tourist visa, and they issue you a NEW permit. so what she is saying doesn't make sense.
as far as you taking the baby...if you don't have proper documentation, you can't take the baby over...they will think you are stealing it. as far as i know, written permission just isn't going to work. you'll need much more than that...if it's even possible. i'm sorry i can't tell you what you'll need, but i am saying what your friend is telling you does NOT make sense, and YES you can get in serious trouble for taking the baby over....not because the baby doesn't belong there, but because it does look like you took the baby. why don't you go to www.uscis.gov and try to find more information.

The crime would be enabling her to come under circumstances (non tourist) that she is not permitted for. Kidnapping is a stretch. However, his birth certificate won't have you on it, so they may nab you under the Hague convention (anti child kidnapping pacts.)

I'm thinking that, even though the baby is a US citizen, because she is NOT a US citizen, they will assume that she plans to stay on in the USA and that is why she can't come in with the baby. If they have a reasonable suspicion that she will not return to Mexico, they will not let her in and her trying to bring the baby in with her would supply that reasonable suspicion. I think you should not put yourself at risk by involving yourself in this situation.
