Because they came to our country and are asking to be legalized which is an immigration issue.

If you need authority on the fact that illegals are nonimmigrant, just look at the text of agjobs. It is clear they were trying to avoid the term 'illegal aliens' in discussing legalization of a number of agricultural workers. What they came up with is 'nonimmigrant aliens'.
