H1B visas to be 'uncapped' if graduate from US schools under 'comprehensive' bill?

"Like those earlier sidelined bills, Strive proposes to increase the annual cap on H-1B visas -- the visa most commonly used for foreign technology pros -- from the current ceiling of 65,000 to 115,000. The Strive act also proposes increasing the limit up to 180,000 in subsequent years if the 115,000 cap is reached during a given fiscal year. In addition, the bill proposes exempting from the cap certain individuals who have earned an advanced degree in science, technology, engineering, or math at U.S. schools."

I'm not against some raise of H1B, but with the way Bush has been giving scholarships and promises of foreign student seats like candy, this would be a huge loophole that could dwarf the actual cap. What do you think?

H1B is employer centric and it believes that the employer will abide by the law. Congressional intent was good, reality is worse. If you look at other countries in the world those countries value higher education. Infact UK gives a special advantage to people who has graduated from top 50 B schools in the world.

Answering your Q of raise of H1B cap and If I were to pick I would rather pick students who are eductaed here than H1B's coming off the boat. This makes it easy for both students who eventually become H1B's and for administration because they can verify the degree and credentials.

Will it dwarf the cap? Are you asking that the original H1B cap will be left unused? NO! Bodyshops around the world will pump in and fill the cap as long as the economy doesnt skip into recession.

Dont worry! None of these bills will get passed because Conservative Rep's will not vote for the whole illegal bill which has the legals in form of amendments. Every body cares about the illegals because their number is more than legals. Ironical but true.

Thanks for the edit which made your point clear. As of now there are 20K visas allocated for US educated students. This was consumed in a span of 4 months. Students who are on F1 after completing their education will either return back or will have to move on to another visa to maintain status. The most easiest way is H1B. As of now many of the 65,000 are being used by people who are on H4/L1/L2/F1. Precisely they are taking F1 out of that picture and making it capless and creating room for others (out of the country as well). It will create a problem when the economy goes down as there will be more jobless people, who will go out of the country as they dont have job/live with out status. The situation is so dynamic that we cannot predict when the demand for people goes up and down. For example, the real estate can tank down right now because of the sub prime mortgage lending and can take a lot of sectors down along with it. what ever!
