Can I leave while petitioning for K-1?

My girlfriend is applying for a K-1 visa so I can come back into the states. We are leaving for vacation in July and I was wondeirng if she can leave the country while we are applying fot th K-1 visa?

Very confused by your post in determining who is the US Citizen and who is not, you or your girlfriend??? Your title says 'can I leave' yet your post says 'can she leave'.

The US Citizen can leave the US while a petition is in process. The only thing you would need to consider is, if your vacation is going to be of any great length, USCIS may send out correspondence such as an RFE (request for evidence).

Yes, while the status is pending you can travel where ever you want. Once you receive it and are applying for your AOS you have to be in the USA for 2 yrs. You can apply for a special visa to leave, but that's costs you and you need to have a good reason, why you're leaving.

I Understood as you GF - is a US Citizen. You are the fiancee.
Yes yshe can travel with you. Just be sure back home someone opens mail, and can contact yuo if something goes wrong or right for that sake.


Be sure to keep all receipts from travel, make photoes, and so on to show to consulate (Will help with approvel).
So its actually a good idea.
