I really need some help on this. My brother immigrated to US when he was 5 yrs old with my parents from Europ

My parents became citizens and he automatically became a citizen because of his age. This was 50 yrs ago. He has paid into S.S. since age 16, been married 3 times to American women, paid taxes, voted, etc. But now he needs to get S.S. benifits and disability benefits because of cancer and they are denying him this because he can't prove he is a US citizen because he doesn't have his greencard he got 50 yrs ago. His own Cobra health ins will run out very soon and doesn't have time it takes to go through the Goverment red tape to get disability benefits he's entitled to since he's been here for 50 yrs and paying into the system. Anybody know how to get through the Government process quicker? If I knew spanish I would ask this in spanish cuz I know I'd get a million answers on exactly what to do. But no speeky spany. I live in America (i thought)

Unfortunately,with disability benefits,it takes time,and sometimes lots of time.The government takes it's time with anyone applying,most times you are denied at least once.
His best option is to get a SS lawyer to help him through the process.They could also help him in proving he is a legal citizen.
Once you are approved for disability,there is still a long waiting period before you are eligible for health benefits,I'm thinking a year,but I may be wrong.
If he has no income,or limited income,he can apply for medicaid with the welfare department.He may also qualify for some other benefits through them while he is waiting for SS to decide on his case.

His age and date he arrived in the States should be proof, surely? Why hasn't he kept any of his parents documents that would prove he came with them? How long has he voted? What about the electoral rolls? They go back for years, don't they. Have a good day.
contact your congressman and get a bunch of letters attesting to his case...best bet!

To establish his citizenship to SSA, he may want to obtain a US passport. Evaluating whether citizenship was transmitted to him by his parents can be somewhat complicated. It's not always automatic. I'm wondering why SSA would be asking for the green card--this establishes permanent residency, not citizenship.

In any event, if he can establish it with Dept. of State and obtain a passport, there's his proof for SSA. If he never gained citizenship and is still a permanent resident, I'd say file an I-90 for a new green card, but you seem to think he did automatically gain citizenship in which case he has no green card to renew.

He can and probably should file a Freedom of Information Act (FOIA) request to USCIS to get copies of everything Immigration has on him. He should do the same for his parents' records because their history might establish his citizenship. The FOIA is filed on a G-639 and takes about 12-14 months.
If he was from Europe the government or the bleeding heart liberals won't care but if he was Hispanic they would hurry to do it. Looks like he's stuck with red tape.
