Many apply for visas in Jordan. We gave twice as many visas to Iraqi's in 2006 as in 2005. Some have tried asking for asylum, but I don't know if any of those cases have been decided. I have seen one report of people coming in illegally and being caught and thrown in jail because the judge said they passed through 3 countries which had US embassies where they could have applied for asylum, and didn't, so their motives were suspect. You don't want to be suspect.
On the other hand, I admit I saw an article where a family came illegally but turned themselves in to the border officials (not trying to enter illegally) and asked for asylum and they were on parole with their families near Michigan while their case was being considered. However, the kids weren't in school yet or anything (although I suspect that if they were in a position to pay for private school they might have been allowed to do that.)
I think the visa or asylum claim through the Jordan embassy is the best bet.
