Is Johnny Sutton getting nervous ? Sutton said that the sentence may well be severe Congress sets sentencing ?

Sutton has said that the sentence may well be severe, but pointed out that Congress sets sentencing guidelines.

Sen. Dianne Feinstein (D-Calif.), who initiated the hearings, has disputed that point in letters to the Justice Department asking why charges carrying such heavy sentences had to be brought.

Sutton said, "It is the policy of the Department of Justice to bring the highest most readily provable charge against a defendant. We followed that policy in this case because what former agents Compean and Ramos did was a serious crime."

It is the policy of the Department of Justice to bring the highest most readily provable charge against a defendant.
It's still a judgment call on the part of the prosecutor. They did what they did because they wanted to, no more, no less.

Sutton charged them with a crime in no way intended for this circumstance, which is for bank robbers and drug dealers committing felonies with a gun.

Answer:
This has the long hand of the Mexican Government protecting not only their citizen, the drug dealer, and his drug trade. This could have been an administrative hearing but because of the insistence of the Mexican government demanding so called Justice for one of their own, it turned into a federal case
Sutton should be in prison instead of Nacho & Jose! He lied to Congress and in court. He is the criminal, not the two border agents that have been political prisoners for 180 days!
That is insane. A prosecutor is supposed to bring a just charge. Not the highest the facts can support regardless of the lunacy of the charge.

I've got to see this.
