Getting a K-1 visa and going on vacation?
My girlfriend and I are planning on getting married. I am currently on my OPT and this will expire in July. I don't know how long it takes to get a K-1 visa. We did not file any papers yet but we both want to go on vacation to my homecountry in April until May. I was told that I shouldn't come back on my F-1 visa but on a tourist visa. But isn't it immigration fraud if I marry on a tourist visa? Is it just easier if we marry in Germany and then I come back on a marriage visa? How long does it take to get that visa?
Thank you so much

Answer:
You can marry on a tourist visa but will be required to leave the country while your spouse files a petition to have you re-enter... that can take up to 2 years.
You need to start your paperwork now.
check USCIS.GOV or call your local border for questions.
You should definitely not marry on a tourist visa.
If you go to your home country and enter back into the U.S. and you have a F-1 visa they will process you as such.
The process to get your paperwork can take months.
